JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-04-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. From the report of the Additional Sessions Judge-III, Vaishali at Hajipur dated 1st of April, 2021 it appears that nonbailable warrant has been issued against non-official witnesses. While refusing the prayer for bail vide order dated 25.06.2020 passed in Cr. Misc. No.17705 of 2020 by this Court, liberty was granted to the petitioner to renew his prayer for bail after six months if no substantive progress is made in the trial. The Court directs the Superintendent of Police, Vaishali at Hajipur to ensure production of all the official witnesses for their examination within a period of three months from the date of receipt/production of a copy of this order.

Patna High Court CR. MISC. No.10306 of 2021(3) dt.16-04-2021 2/2 Considering the fact that trial has not been concluded as per direction made by this Court vide order dated 25.06.2020 passed in Cr. Misc. No.17705 of 2020, the court below is directed to conclude the trial on day-to-day basis within a period of six months failing which the court below shall release the petitioner on bail on appropriate terms and conditions. The court below is under obligation to furnish reasons for not following the observations made by this Court vide order dated 25.06.2020 passed in Cr. Misc. No.17705 of 2020 before Registrar (Vigilance) of this Court.

The application stands disposed of.
