JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-08-2019 The petitioner apprehends her arrest in connection with Laxmipur P. S. Case No. 69 of 2019 registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code. Allegation against the petitioner is that she was Mukhia of Gram Panchayat-Najari, P.S. and Block- Laxmipur, DistrictJamui and in course of investigation, it was found that experience certificates of three teachers appointed by the petitioner were found to be forged.

Learned counsel appearing on behalf of the petitioners submits that petitioner is Mukhia and appointment was made by the appointment committee consisting of five members and there was no mechanism to verify the certificates produced before her. It is further submitted that the persons who were

Patna High Court CR. MISC. No.51853 of 2019(2) dt.20-08-2019 2/2 appointed on the basis of false certificates, have already been granted anticipatory bail by the co-ordinate Benches of this Court in Cr. Misc. Nos. 32305 of 2019 and Cr. Misc. No. 35445 of 2019.

After having heard learned counsel for the parties and taking into consideration the fact that petitioner was Mukhia of the Gram Panchayat at the time of making appointment and appointment was not made solely by the petitioner but by an appointment committee, as such I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Jamui in connection with Laxmipur P.S.Case No. 69 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
