JUSTICE ARUN KUMAR ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Mahila P.S. Case No. 31 of 2016 registered under section 498A of the Indian Penal Code and sections 3⁄4 of the Dowry Prohibition Act.
Allegation in brief is that the petitioner has married another girl.
It is submitted that the complainant is claiming herself as a wife but she is a widow, earlier married with another person and there is no allegation in the present FIR that she was tortured in connection with any demand of dowry.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of
Patna High Court Cr.Misc. No.1516 of 2017 (3) dt.08-02-2017 receipt of this order to the court concerned, let the petitioner, namely, Bhramar Kumar @ Varmar Kumar be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Begusarai in connection with Mahila P.S. Case No. 31 of 2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
