The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 347 of 2015 registered under Sections 363 and 365 of the Indian Penal Code. The accusation is that petitioner and his family members kidnapped the daughter of the informant on 17.11.2015. Learned counsel appearing on behalf of the petitioner submits that there was love affairs in between the petitioner and victim. The victim, daughter of the informant, in her statement under section 164 Cr. P.C. stated that she left the house according to her sweet will and went to Kolkata, where she performed marriage in the temple with petitioner and denied her
Patna High Court Cr.Misc. No.44256 of 2016 (2) dt.21-10-2016 2/2 kidnapping. Further submission is that while the informant has alleged that the victim was minor aged about 14 years, but in her medical examination, her age was assessed about 18 to 21 years. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 347 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
