23-11-2016 Heard Sri Sachin Kumar, learned counsel for the petitioner and Smt. Veena Kumari Jaiswal, learned Addl. Public Prosecutor.
The petitioner, who is father-in-law of complainant/opposite party no. 2, has approached this Court with a prayer to grant anticipatory bail.
It was submitted by learned counsel for the petitioner that mother-in-law as well as some other co-accused have already been extended the privilege of anticipatory bail by the court below itself. The prayer for anticipatory bail of the petitioner and husband of the complainant has been rejected. He submits that being father-in-law, the petitioner has committed no offence.
Patna High Court Cr.Misc. No.47945 of 2016 (2) dt.23-11-2016 2/2 Keeping in view the fact that petitioner is father-inlaw and mother-in-law of the complainant has already been extended the privilege of anticipatory bail, there is no reason to deny the prayer for anticipatory bail.
Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Ram Vriksha Rai @ Ram Briksha Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Samastipur in connection with C.R. No. 1993 of 2015 (T.R. No. 3723 of 2016), subject to condition, as laid down under Section 438(2) of the Cr.P.C.
