2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a)/ 32 (ii) of the Bihar Prohibition and Excise Act.

3. Prosecution case is that 80 liters liquor has been recovered from the house of husband of the petitioner.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner.

5. However, learned counsel for the State opposes the

Patna High Court CR. MISC. No.54973 of 2023(2) dt.28-08-2023 2/2 prayer for bail and submits that petitioner has got two criminal antecedents of similar nature .

6. Considering the facts of the case as also the fact that petitioner has got two criminal antecedents of similar nature , prayer for anticipatory bail is rejected.
