The facts leading to the writ petition stands noted in the order of this Court passed on 20.6.2017 and it is the case of the petitioner as espoused by Mr. Sinha that even though the petitioner figured in the final list so published, she was held disqualified. It is in these circumstances and to ascertain reason that learned counsel for the respondents was granted time and when he has returned with the

Patna High Court CWJC No.4435 of 2017 dt.13-07-2017 counter affidavit enclosing the verification Committee's report at Annexure C/5 which shows that the petitioner had not cleared her 7th Semester having failed in one of the papers. The position is confirmed by Annexure C/4, which shows that in 7th Semester the petitioner had failed to secure passing marks in the Protection of Power Apparatus and System paper and cleared the same only in January, 2017 with Grade A+, as confirmed from Annexure C/8. The result was published only on 9.1.2017 when the cut off date for possessing necessary qualification in terms of the notice is 1.8.2016. In the circumstances discussed, no cause for indulgence is made out.

The writ petition is disposed of.
