JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The victim in her statement recorded under section 164 Cr. P. C. has stated that out of her sweet will she went with the petitioner to his relative's house for the purpose of marriage but when she learnt that she is underage, she herself appeared before police. She has not made any allegation of sexual assault or any wrong against the petitioner. Petitioner has claimed clean antecedent and he is in custody since 9.8.2021. Considering the aforesaid facts and circumstances of

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III Dalsingsarai, Samastipur in Vidyapati Nagar Police Station Case No. 93 of 2021.
