The petitioner apprehends his arrest in Basantpur P.S. Case No.251 of 2020, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 354, 504, 506 and 34 of the Indian Penal Code.

The petitioner is said to have assaulted the informant by means of daab in the middle of her head. The petitioner again tried to assault the informant on her neck. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is submitted that there is general and omnibus allegation against the petitioner. The petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

Patna High Court CR. MISC. No.10310 of 2021(2) dt.14-12-2021 2/2 Learned counsel for the State opposed the prayer for anticipatory bail of the petitioner and submitted that the injury found on the person of the informant is grievous in nature. Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

However, the petitioner is directed to surrender before the learned court below within four weeks from today and the learned court below shall consider the prayer for regular bail of the petitioner preferably on the same day without being prejudiced from the order of this Court.
