The petitioner apprehends his arrest in connection with Vaishali (Belsar O.P) P.S. Case no.180 of 2016, registered under Sections 406 and 420 of the Indian Penal Code. The allegation of informant Ram Ekbal Singh is that Abhinav Kumar runs a shop in the name of 'Abhinav Marketing & Consultancy Company' in which he used to deposit the money of the public with assurance that he will return the money with handsome interest after two years. The informant also opened two accounts in the said company and deposited money, but after maturity money was not returned to him.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that Abhinav Kumar used to run the company in the name of Abhinav Marketing & Consultancy Company for
Patna High Court Cr.Misc. No.55015 of 2016 (2) dt.23-12-2016 2/2 borrowing the money with assurance to return the money with high interest to the public the petitioner and others, who are family members, has also been made accused saying that they also used to help in the business of Abhinav Kumar, except that there is nothing against the petitioner. Further submission is that there is no specific allegation against the petitioner and the petitioner being the own brother of the accused Abhinav Kumar have been implicated in this case.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (Belsar O.P) P.S. Case No. 180 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
