Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act, registered in connection with Katra P.S.Case No. 93 of 2021. As per allegation, the police got a confidential information that some miscreants are planning to commit some serious offence. The police raided the place of occurrence. Three of them were arrested and other fled away. Some arms and ammunitions were recovered from the arrested accused persons and they disclosed the name of the petitioner. The learned counsel for the petitioner has submitted that he was not arrested at the spot. There is nothing against

Patna High Court CR. MISC. No.53954 of 2022(2) dt.31-01-2023 2/2 him, except the confessional statement of co-accused persons. Though there is one case against the petitioner, but he is on bail in that case.

On the other hand, the learned APP has opposed the prayer for anticipatory bail.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Muzaffarpur (East) in connection with Katra P.S.Case No. 93 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
