The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 467, 468, 406, 120B and 34 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that pursuant to an agreement for sale of immovable property entered into between the informant and the petitioner, although total consideration amount was paid by the informant to the petitioner, however the petitioner while executing the sale deed mentioned incorrect plot number in the sale deed. It is further stated that subsequently the plot of land which the informant had agreed to sell to the informant was sold to some other person.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.63744 of 2021(4) dt.17-05-2022 2/2 that the petitioner has been falsely implicated in the case. The dispute is purely civil in nature. The petitioner is in custody since 6.7.2021 and charge sheet has been submitted in the case. The application for bail is opposed by learned APP for the State who submits that the petitioner absconded for nearly eight years.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR together with the petitioner having remained in custody for 10 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Dinara P.S. Case no. 212 of 2013 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Bikramganj, Rohtas.
