The petitioner is apprehending his arrest in connection with Kotwali P.S.Case nO.451 of 2017 registered for offences punishable under Sections 417, 418, 419, 420 and 120B of the Indian Penal Code and Section 66(A) and 66(D) of the I.T. Act. Allegation as per FIR against the petitioner is that one Chandan Kumar contacted the son of the informant on WhatsApp and gave his account number and asked him to deposit the money for passing in the T.E.T. Skill Test examination, 2017. Name of the petitioner has transpired during the course of investigation. Submission of the learned counsel for the petitioner is that except suspicion there is nothing against the petitioner. Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.10109 of 2018 (3) dt.09-04-2018 2/2 bail on the ground that he has criminal antecedent and he is accused in two other cases of similar type.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
