The petitioners seek pre-arrest bail in connection with Mushahari P.S. Case No.53 of 2017 corresponding to G.R. No.1516 of 2017 registered under Sections 147, 148, 149, 341, 323, 307, 353, 452, 427, 120B and 283 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the case of the petitioners stands on identical footing to that of co-accused Ramesh Kumar who has already been granted prearrest bail by a Bench of this Court vide order dated 20.12.2017 passed in Cr.Misc. No.44599 of 2017 Learned counsel for the State has opposed the prayer for

Patna High Court Cr.Misc. No.18224 of 2018 (2) dt.05-04-2018 2/2 grant of pre-arrest bail to the petitioners. However, he admitted that the case of the petitioners stand on identical footing to that of co-accused Ramesh Kumar, who has already been granted prearrest bail by Bench of this Court. Considering the reasons assigned in the order dated 22.12.2017 passed in Cr. Misc. No.44599 of 2017, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Muzaffarpur in connection with Mushahari P.S. Case No.53 of 2017 corresponding to G.R. No.1516 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
