1. The present writ petition has been filed seeking the following relief(s):- "1. That the Petitioner craves indulgence of this Hon'ble court for issuance of an appropriate writ in the nature of MANADAMUS or any other appropriate writ/writs, order/orders, direction/directions, command/commands, for directing the respondents to pay rented dues of four years i.e. @ Rs. 4596/- per month, totalling to a sum of Rupees 2,20,608 (Two Lakh Twenty Thousand and Eight Rupees) with interest."

2. At the outset, the learned counsel for the respondent no.4 i.e. the Executive Officer, Nagar Panchayat, Sonepur,

Patna High Court CWJC No.12620 of 2024(2) dt.02-09-2024 2/2 District- Saran, submits that the rent agreement had been entered in between the deceased father of the petitioner, namely Late Pashupati Nath Singh and the respondent no.4, for enabling the Nagar Panchayat, Sonepur, to run its office in the tenanted premises, belonging to the deceased father of the petitioner, however, it is submitted that nothing has been produced by the petitioner before the respondent no.4 in proof of the fact that the petitioner is the sole legal heir, hence in case a Succession Certificate is obtained and produced by the petitioner, the outstanding rent would definitely be paid, within a period of four weeks, thereafter.

3. At this juncture, the learned counsel for the petitioner submits that the petitioner be granted liberty to obtain Succession Certificate and approach the respondent no.4 for payment of the outstanding rent. Liberty so sought is granted.

4. The writ petition stands disposed off on the aforesaid terms.
