Heard learned counsel for the petitioner, Shri Avanish Kumar Singh and learned APP for the State, Shri Chandra Bhushan Prasad.

The Deputy Superintendent of Police, Raniganj, Araria, the S.H.O, and the Investigating Officer of the case, in compliance of the order dated 21-8-2025, are present in the Court. 3.

The SHO, at the outset, submits that case was under investigation and the Police is going to submit final form exonerating the petitioner of the allegations as alleged in the FIR as during the course of investigation no material transpired which could even remotely connect the petitioner with the offence. 4.

Learned APP, Shri Chandra Bhushan Prasad, submits that since final form is going to be submitted, as submitted by the SHO, hence petitioner does not have any apprehension of arrest for the present.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.53681 of 2025(3) dt.22-08-2025 2/2 as such seeks permission to withdraw the anticipatory bail application with liberty to file afresh, if need arises. 6.

Permission is accorded.

Accordingly, the anticipatory bail application is dismissed as withdrawn with the liberty aforesaid. 8.

At this stage, the learned APP submits that the Dy.S.P, who has come in compliance of the order dated 21-8-2025, was posted as Dy.S.P, Raniganj, Araria, when the case was under investigation but subsequently he has been transferred, but since he was associated with the case, as such has come to assist the Court. 9.

The personal appearance of the Deputy Superintendent of Police, Raniganj, Araria, the S.H.O, and the Investigating Officer of the case, is dispensed with.
