The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 109, 323, 307 & 302 of the Indian Penal Code.

The prosecution case in brief is that 14 persons including the petitioner having variously armed reached the informant's house and at the behest of co-accused Faiyaz Ahmad, one Md. Anjar Ansari assaulted the informant with iron rod. Thereafter, Faiyaz Ahmad is said to have assaulted the informant. It is also alleged that all the accused persons assaulted Md. Aslam who died en route to proceeding for better treatment to PMCH. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation

Patna High Court CR. MISC. No.51054 of 2019(2) dt.17-08-2019 2/2 of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 01-04-2019. Charge sheet has already been submitted. The deceased is alleged to have been assaulted by Faiyaz Ahmed and Mustafa Ansari. There is no allegation of assault upon the deceased alleged against the petitioner. The petitioner is said to have assaulted the informant. The injury sustained by the informant is simple in nature. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VI, Bettiah, West Champaran in connection with Kudhani P.S. Case No. 125 of 2019, G.R. No. 1272 of 2019.
