JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 This is an application for grant of anticipatory bail in connection with Patliputra P. S. Case No. 282 of 2018, disclosing offences under Sections 304B/34 of the IPC and Section 3(2)(r) of the SC/ST Act.

As per F.I.R. petitioner happens to be the mother-inlaw of the deceased. There is allegation against the petitioner and others that they strangulated the deceased for demand of Rs.10,000/-.

Submission of the learned counsel for the petitioner is that the husband of the deceased is already in custody and she has falsely been implicated in this case.

Heard learned A.P.P. also and submitted that dead body was found from the house in which petitioner and deceased were residing and cause of death is strangulation.

Patna High Court CR. MISC. No.49934 of 2019(4) dt.20-12-2019 2/2 Having heard both sides, in view of the allegation against the petitioner and her son, I am not inclined to grant privilege of anticipatory bail to the petitioner. She has to surrender before the learned court below and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
