2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 352, 303(2), 109(1), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. Prosecution case, in brief, is that on 12.04.2025 at about 4:30 PM, when brother of the informant and with his uncle was returning home, all the F.I.R. named accused persons
Patna High Court CR. MISC. No.51734 of 2025(3) dt.28-11-2025 2/3 brutally assaulted them with butt of rifles. It is further alleged that the accused persons also snatched gold chain and mobile phone.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is bodyguard of the co-accused Sachin Gupta . Petitioner is not named in the F.I.R. and his name transpired during course of investigation on confessional statement of co-accused Rajni Kant. Save and except confessional statement, there is no other material available on record to substantiate the allegation levelled against petitioner. Similarly situated co-accused person has already been granted bail by this Hon'ble Court vide order dated 11.09.2025 in Cr. Misc. No. 62153 of 2025 . Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case and nature of accusation , clean antecedent of this petitioner and other circumstances of case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond

No.51734 of 2025(3) dt.28-11-2025 3/3 of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate , Ist Class, Bhojpur at Ara in connection with Bihiya P.
