JUSTICE SUDHIR SINGH ORAL ORDER 25-11-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Nayagaon P.S. Case No. 54 of 2016, G.R. No. 3623 of 2016 for the offences instituted under Sections 420, 467, 468, 471, 504 and 120B of the Indian Penal Code. The petitioners alleged to have sold certain piece of land to the informant, which was already sold earlier by another co-sharer.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the
Patna High Court Cr.Misc. No.50820 of 2016 (2) dt.25-11-2016 2/2 petitioners. The matter relates to civil dispute. The petitioners claim that they have executed sale deed in respect of his own share of the property. Till date, no suit has been filed in respect to the sale deed in question.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Nayagaon P.S. Case No. 54 of 2016, G.R. No. 3623 of 2016 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Saran at Chapra subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
