The petitioner apprehends his arrest in connection with Jokihat P.S. Case no. 377 of 2017, registered under Section 379/34 of the Indian Penal Code.
The accusation is that on 20.11.2017 the informant went to see fair after boarding on the red colour motorcycle of his brother and after parking the same, he entered in the fair and when he returned for taking Gamchha then saw petitioner and one Pankaj were sitting on the motorcycle. Thereafter, he again went into the fair and after sometime, when he again returned to the motorcycle then found his motorcycle was missing. On inquiry, nearby people disclosed that petitioner and
Patna High Court Cr.Misc. No.8766 of 2018(2) dt.17-02-2018 2/2 Pankaj have lifted his motorcycle from there. When the informant asked regarding the motorcycle to the petitioner then he demanded Rs. 10,000/- for searching his motorcycle. Learned counsel for the petitioner submits that petitioner is a student and he has falsely been implicated in this case. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 377 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
