This is an application for grant of anticipatory bail in connection with Makhdumpur P.S. Case No. 140 of 2019 registered for the offence punishable under Sections 341, 323, 325, 307, 461, 379, 504 and 506/34 of the Indian Penal Code. The case of the prosecution in brief is that the informant is running a kirana shop and on the alleged date of occurrence at about 5 pm., the family members of the petitioner herein and one Raj Nand Yadav were quarrelling in front of the shop of the informant whereupon the informant is said to have told them to quarrel, after moving away from his shop, whereupon the petitioner is said to have assaulted the informant with fists and slaps and is alleged to have taken away a sum of Rs. 15,000/-.

No.50696 of 2019(3) dt.16-11-2019 2/2 The learned counsel for the petitioner submits that the injury, if any, is simple in nature and the fact is that the alleged incident is false and the petitioner has been falsely implicated in the present case. It is further submitted that though the petitioner is an accused in one other case but in the said case, he is on bail and the same pertains to petty dispute.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad in connection with Makhdumpur P.S. Case No. 140 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
