Petitioners apprehend their arrest in Bhorey P.S. Case No.94 of 2019, registered under Sections 366(A) and 34 of the Indian Penal Code.
The mother of the victim disclosed that Rajan Ram who was doing the work of electric wiring in her house enticed her daughter on 20.02.2019. When the informant went to enquire, the mother, sister and uncle of Rajan Ram disclosed that Rajan Ram had come with a girl but they drove him out from the house. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.52703 of 2019(2) dt.23-08-2019 2/2 petitioners are family members of Rajan Ram. There is no allegation of kidnapping against the petitioners. The victim in her statement under Section 164 Cr.P.C. altogether disclosed a different story and she denied the factum of her kidnapping. She disclosed that for the first time she left her house on 03.12.2018 and solemnized marriage with Rajan Ram in Thawe temple. Taking into consideration the facts aforesaid and the fact that the victim herself denied the factum of her kidnapping and petitioners are family members of Rajan Ram, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Bhorey P.S. Case No.94 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
