JUSTICE RAKESH KUMAR ORAL ORDER 13-02-2018 Heard Shri Anish Chandra, learned counsel for the petitioners and Shri Chaubey Jawahar, learned Additional Public Prosecutor Two petitioners, who are father and mother of one Nitesh Kumar against whom there was allegation that forcibly he married with the daughter of the informant, have approached this court apprehending their arrest in Vaishali ( Belser - O.P.) P.S. Case No. 144 of 2017 , registered for the offence under Section 323, 341, 366(A) , 383, 504/ 34 of the Indian Penal Code , 1860 , Section 27 of the Arms Act 1959 and Section 3⁄4 of the Dowry

Patna High Court Cr.Misc. No.7363 of 2018(2) dt.13-02-2018 2/3 Prohibition Act , 1961 for grant of bail in the event of their arrest or surrender.

Learned counsel for the petitioners submits that initially a complaint petition was filed which was registered as Complaint Case No. 1103 of 2017 which under Section 156 (3) of the Cr.P.C .was referred to the Police for registering FIR and investigating the case. By way of referring to the facts disclosed in the complaint petition, learned counsel for the petitioners submits that on bare perusal of the complaint itself it is evident that victim who was allegedly seventeen year old in the complaint petition itself had left with the son of the petitioners. Besides hearing, I have perused the materials available on record and the FIR and after going through the same, I am of the view that it is a fit case for extending the privilege of anticipatory bail. Accordingly in the event of arrest or surrender within a period of six weeks from today, let both the petitioners (1) Lalan Singh (2) Geeta Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Chief
