The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 342, 323, 324, 307 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is in custody since 16.01.2022 and has antecedent of two cases and the informant alleges that the accused persons, including the petitioner, assaulted his son and Kallan fired repeatedly injuring his son.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that allegation of firing is against Kallan and

Patna High Court CR. MISC. No.54200 of 2022(2) dt.04-01-2023 2/2 petitioner is alleged to have assaulted his son, but then the allegation of assault is general and omnibus in nature. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submission made by the learned counsel for the petitioner, the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pirpainti P.S. Case No. 29 of 2016.
