This is a petition for grant of anticipatory bail for offence under Sections 272, 273 and 290 of the Indian Penal Code and 47(a) of the Excise Act.
Four hundred bottles containing 400 ml each of country made liquor were recovered from the house of the petitioners.
Submission is that in fact the house is of the father of the petitioners, who is also a co-accused. The seizure list would reveal that the recovery was from the house of Manohar Yadav, the father of these petitioners. The ration card would reveal that the petitioners are separate.
Considering the aforesaid fact, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Shankarpur P.S. Case No. 30 of 2016 to the satisfaction of the Judicial Magistrate, 1st Class, Madhepura, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
