The petitioner apprehends his arrest in connection with Economic Offence Case No. 01 of 2016 registered under Sections 420, 466, 467, 468, 471 and 120B of the I.P.C. pending in the Court of S.D.J.M., Patna.

Submission is that petitioner is an advocate clerk. He is innocent and has falsely been implicated in this case. Further submission is that petitioner has identified the signature of the deponent only on the request of the counsel.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending

Patna High Court Cr.Misc. No.45618 of 2017 (4) dt.15-11-2017 2/2 that petitioner is named in the F.I.R. and there is direct allegation of forgery against him. Hence, he does not deserve anticipatory bail.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
