The petitioner is in custody since 01.07.2019. Learned counsel for the petitioner submits that the petitioner is custody in connection with Makhdumpur P.S. Case No. 215/2018 registered for the offence punishable under Sections 379/411 of the Indian Penal Code. Learned counsel for the petitioner further submits that for the same offence another case was also instituted at Tekari (Tekari P.S. Case No. 306 of 2018) under Sections 414/34 of the Indian Penal Code. It is submitted that the petitioner is not named in the FIR, but subsequently, he was arrested on suspicion and, thereafter, he was made to give his own confessional statement before the police which has no evidentiary value. Case No. 306 of 2018 is concerned, he has already been extended the privilege of bail by this Court on 10.12.2018 passed in Cr. Misc. No. 71557 of 2018.

Considering the aforementioned facts and circumstances and that save and except the other case, referred to hereinabove, the petitioner has no criminal antecedents, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Jehanabad, in connection with Makhdumpur P.S. Case No. 215/2018.
