This application for anticipatory bail arises out of Chousa P.S. Case N0. 103 of 2014, disclosing offences under Sections 147,148,149,341,323,325,307,504 and 506 of the Indian Penal Code.
On perusal of the First Information Report, it can be easily seen that the occurrence is said to have taken place in the background of a land dispute. There is general and omnibus allegation of assault with slaps and fists. Consideration the nature of accusation, this application is allowed.
Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount
Patna High Court CR. MISC. No.50323 of 2019(2) dt.13-08-2019 2/2 each to the satisfaction of the learned SubDivisional Judicial Magistrate, Udakishunganj at Mahdepura in Chousa P.S. Case No. 103 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
