JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Piro P.S. Case No. 239 of 2016 registered under Sections-379/34 of the Indian Penal Code.

According to prosecution case, the stolen buffalos were recovered from Daleeppur and the petitioner along with others escaped from there when the villagers tried to catch them. The informant claims that the villagers of Daleeppur named the petitioner and one Asgar Ansari. Subsequently, Asgar Ansari was arrested and confessed his guilt, disclosing the name of the petitioner.

It appears that except the aforesaid material, there is

Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Piro P.S. Case No. 239 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Ara, Bhojpur subject to conditions as laid down under Section-438(2) of the Cr.P.C.
