JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-11-2017 Heard Mr. Rajeev Kumar Singh, learned Counsel appearing on behalf of the petitioner and Mr. Vinay Kumar Mishra, learned AC to AAG-15 appearing on behalf of the respondent-State.
The present application has been filed for modification of the order dated 15.12.2016, passed in CWJC No. 630 of 2011 to the extent of extending the period of filing appeal by the petitioner before the appropriate authority.
It is submitted by learned Counsel appearing on behalf of the petitioner that in pursuance to the aforementioned order, the petitioner was permitted to file appeal before the appropriate authority within a period of four weeks, but due to the serious illness of the petitioner, he could not file such appeal and hence the present modification application.
Patna High Court MJC No.563 of 2017(3) dt.22-11-2017 2/2 Learned Counsel appearing on behalf of the respondentState has no objection in such modification. In the circumstances, the period for filing of appeal by the petitioner is extended by three weeks from the date of receipt/production of a copy of this order.
The order dated 15.12.2016 passed in CWJC No.630 of 2011, stands modified to the extent as indicated above. The modification application is, accordingly, disposed of. (Dinesh Kumar Singh, J) Ashwini/- U
