JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-07-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A), 368 and 120(B)/34 of the Indian Penal Code.
It is a case of abduction of the sister of the informant by the accused persons including the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail and submitted that from perusal of the case diary, it appears that in the statement recorded under
Patna High Court CR. MISC. No.63657 of 2021(3) dt.13-07-2022 2/2 Section 164 of the Cr.P.C. the victim girl has stated her age about 15 years and has supported the case of the prosecution as well as stated that the petitioner along with other co-accused took her away Barauni and then Himachal Pradesh and forced her to sell ganja. Petitioner is named in the FIR. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.
