JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 The petitioner seeks regular bail in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 107 of 2019, registered for offences punishable under Sections 304(B)/ 34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and allegation against him is of causing death of deceased in connection with demand of dowry.

It has been submitted on behalf of the petitioner that the deceased had committed suicide by hanging herself and petitioner has falsely been implicated in this case and no specific allegation has been attributed to him and he has been in judicial custody since 02.04.2019.

Patna High Court CR. MISC. No.51533 of 2019(3) dt.16-11-2019 2/2 Heard learned A.P.P. also as well as learned counsel for the informant. They have opposed the prayer of bail of the petitioner.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. However, if any substantial progress is made in trial, petitioner will be at liberty to renew his prayer for bail in the Trial Court itself, which will be disposed of by the Trial Court on the basis of materials available at that time.
