JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-08-2019 Petitioner no.2 is stated to have been arrested, during the pendency of the application and accordingly this application, to the extent it relates to him has become infructuous. This application is accordingly dismissed as having become infructuous to the extent it relates to petitioner no.2. Heard learned counsel for the parties.

This application for anticipatory on behalf of petitioner no. 1, namely, Geeta Devi, arises out Kako (Bhelawar) P.S. Case No. 153 of 2019, disclosing offences under Sections 341, 323, 325, 504, 506 and 307/34 of the Indian Penal Code.

Learned counsel for petitioner no.1 has submitted that the main allegation is against petitioner no.2 and so far as petitioner no.1 is concerned, there is no serious allegation against her.

Learned counsel for the informant and learned APP for the State have vehemently opposed the prayer for grant of anticipatory bail.

However, considering the nature of allegation against petitioner no.1, who is a female, this application is allowed. Let petitioner no.1, Geeta Devi, in the event of her arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of Sri Umesh Prasad, the learned Judicial Magistrate, 1st Class, Jehanabad in connection with Kako (Bhelawar) P.S. Case No. 153 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
