====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Mojahidpur (Babarganj) P.S. Case No. 268 of 2018 for the offenses under Sections 395 and 412 of the Indian Penal Code. Learned counsel for the petitioner submits that the FIR has been lodged against unknown persons. The petitioner has been made accused in the instant case because of his past criminal antecedents. In this case, case diary was called for and received. Case diary transpired that nothing was recovered from the possession of the petitioner. The petitioner is in custody since 26.03.2019.

Considering the aforesaid facts and circumstances, the Court is inclined to grant bail to the petitioner. Let the petitioner,

Patna High Court CR. MISC. No.49784 of 2019(5) dt.03-02-2020 2/2 above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Mojahidpur (Babarganj) P.S. Case No. 268 of 2018.
