JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-02-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Sadar P.S. Case No. 457/2017, instituted for the offences punishable under Sections 457, 380, 411/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that this petitioner was not apprehended on the spot. His name has transpired only in the confessional statement of co-accused Karan Rishi who simply named this petitioner and two others. Nothing has been recovered from possession of this petitioner and he has got clean antecedent.
Learned A.P.P. for the State is present.
Patna High Court Cr.Misc. No.7237 of 2018 (2) dt.20-02-2018 2/2 Considering the fact that the petitioner has got no criminal antecedent and he has been involved only on the basis of extra-judicial confessional statement of the co-accused, let the petitioner above named, in case of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 457/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
