JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Petitioner apprehends his arrest in connection with Udwant Nagar P.S. Case No. 279 of 2017 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
Allegation against the petitioner, who happens to be the Director of Dream Heaven's Homes Private Limited and doing the construction work of the flats, is that he has been taken money from the complainant and not handed over the flat. Submission of learned counsel for the petitioner is that the same amount is still due with the complainant and further due to dispute with the land owner, the construction work was stopped but the work is started and he is ready to hand over the flat to the
Patna High Court Cr.Misc. No.32089 of 2018 (3) dt.27-06-2018 2/2 complainant if he is granted two years time.
Heard learned APP as well as learned counsel for the complainant.
Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks from the receipt of this order and file an undertaking before the learned court below that he will hand over the flat to the complainant within a period of one year. Once such undertaking is filed the learned court below shall release him on bail to its own satisfaction.
With the above observation, this application is disposed of.
