JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2018 Petitioner apprehends his arrest in connection with Hilsa P.S.Case No. 489 of 2017 registered for the offences under Sections 341, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation as per FIR is that one of the accused persons has fired on the informant but did not hit anybody and motive behind the occurrence is admitted land dispute between the petitioner and co-accused RamBali Chauhan.

Submission of learned counsel for the petitioner is that there is no overt act alleged against the petitioner and there is land dispute between the petitioner and Rambali Chauhan. Heard learned APP also.

In the facts and circumstances, let the petitioner, above

Patna High Court Cr.Misc. No.3627 of 2018 (2) dt.05-02-2018 2/2 named, in the event of his arrest/surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Hilsa P.S.Case No. 489 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation of the case and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
