The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that on account of trivial issue, the accused persons, variously armed, fired indiscriminately and assaulted his nephew causing his death. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.5.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. General and omnibus allegation

Patna High Court CR. MISC. No.50894 of 2019(3) dt.19-11-2019 2/2 has been made against the petitioner. No specific overt act is alleged against the petitioner. Altogether 23 persons are named in the F.I.R. No specific injury is attributed against the petitioner. Other co-accused has been granted bail vide order dated 10.2.2016 passed in Cr. Misc. No. 55271 of 2015. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Morkahi P.S. Case No. 56/2014.
