The petitioner has prayed for bail in connection with Bhagwanpur P.S. Case No. 256 of 2021 registered for the offence punishable under sections 366(A) of the Indian Penal Code.

Prosecution case relates to abduction of niece of the informant.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in the present case. Petitioner is innocent. In the statement of the victim girl recorded u/s 164 Cr.P.C. she has clearly stated that her uncle and aunt forcibly doing her marriage with an old man due to which

Patna High Court CR. MISC. No.54154 of 2022(3) dt.16-02-2023 2/2 out of her own sweet will, she has left her house and solemnized marriage with the petitioner on 19.12.2021. Petitioner is languishing in judicial custody since 01.07.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Begusarai in connection with Bhagwanpur P.S. Case No. 256 of 2021.
