1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in in connection with Nautan P.S. Case No.185 of 2021, registered for the offences punishable under Sections 302, 120(B)/34 of the IPC and section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner has antecedent of two cases and the FIR was against unknown, and the name of the petitioner transpired during the course of investigation. It is further submitted that case of the petitioner is similar to the case of Satyendra Yadav and Pappu Kumar @ Pappu Yadav. It is further submitted that Satyendra Yadav and Pappu Yadav had moved before this Court seeking regular bail by filing Cr. Misc. No. 53601/2022 and Cr. Misc.

Patna High Court CR. MISC. No.62105 of 2025(3) dt.23-09-2025 2/2 No. 68865/2023, and the same was allowed by an order dated 23.12.2022 and 03.11.2023 respectively by learned coordinate Benches, on which, the learned APP submits that if the case of the petitioner is similar to the case of the accused who have been granted the privilege of regular bail, in that event, the petitioner should also seek regular bail as the case is of murder.

4. At this stage, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the anticipatory bail application with liberty to the petitioner to surrender before the learned Trial Court for seeking regular bail.

5. Permission is accorded.

6. It is made clear that if the petitioner surrenders and seeks regular bail, in that event the learned Trial Court would keep in mind that similarly situated co-accused have been granted the privilege of regular bail by this Court.

7. Accordingly, the anticipatory bail application is dismissed as withdrawn with the aforesaid liberty. (Satyavrat Verma, J) pallavi/- U T
