The petitioner apprehends his arrest in connection with Ishakchak P.S. Case no. 94 of 2019, registered under Sections 341, 323, 324, 504, 506 and 307/34 of the Indian Penal Code.
The accusation is that petitioner had taken Rs. Five lakhs, as advance, to sell 1⁄2 katha of land from the informant, but petitioner refused to sell the land. Thereafter, petitioner returned Rs. 2,80,000/- to the informant, but he did not return the remaining amount of Rs. 2,20,000/-. On 22.06.2019, in the evening, when informant was returning to her house along with her son then petitioner along with his wife
Patna High Court CR. MISC. No.50507 of 2019(2) dt.14-08-2019 2/2 Sangita Devi and son Nitish Kumar surrounded the informant and her son and started to abuse the informant. At that time, the petitioner caused injury through wooden portion of the spade at the head of son of the informant.
Learned counsel for the petitioner submits that the allegation is against the petitioner to cause injury at the head of son of the informant through wooden portion of the spade, but the injury found on the person of son of the informant is simple in nature. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S. Case No. 94 of 2019, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
