JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 03-08-2017 This petition under Article 226 of the Constitution has been filed in public interest and on perusal of the cause title it goes to show that the petition has been filed by 'Janta Ki Awaz' through its Executive Member, Pradip Kumar Paswan. 'Janta Ki Awaz' is not a juristic person, or a registered authority nor does it have any legal existence and there is nothing in the writ petition to show as to what is the status of this petitioner titled 'Janta Ki

Patna High Court CWJC No.11086 of 2017 (2) dt.03-08-2017 2/2 Awaz'. The petition is filed in unauthorized manner by an unauthorized person at the instance of such organization which does not have any legal status, that being so, we are not inclined to interfere into the matter. However, if any independent person, who is being displaced by the construction of National Highway, feels that he is entitled to the benefit of rehabilitation under the Bihar Rehabilitation Scheme as formulated by the State on 3rd July, 2015 in notification No. 813, he is granted liberty to approach the State authority seeking benefit of rehabilitation. When he approaches the competent authority, we direct that the State authorities will look into his grievance and decide the same in accordance with law.

With the aforesaid liberty to the individual concerned, the petitioner 'Janta Ki Awaz' having no locus standi to file this petition, we dispose of this petition. (Rajendra Menon, CJ) (Anil Kumar Upadhyay, J) U S.Pandey/-
