Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioner seeks anticipatory bail in connection with Nokha P.S. Case No. 40 of 2021 registered for the offences under Sections 482, 483, 486, 420, 120(B) of the Indian Penal Code and Section 63, 65, 68 of copy right Act and Section 102, 103 and 104 of Trade Mark Act.

The main submissions advanced by learned counsel for the petitioner are that the alleged counter-fitted namkin packet was not purchased from the petitioner which in itself appears from the FIR and there is no details of the petitioner's shop as purchasing place in the seizure cum production list and

No.63783 of 2021(2) dt.15-06-2022 2/2 the informant did not produce any receipt of payment with regard to the alleged recovered duplicate article, in fact the informant pressurized the petitioner to sell the informant's company's product which was not complied by the petitioner and thereafter due to inimical terms the present case was filed. Learned APP has vehemently opposed the bail prayer. Heard both the sides and perused the FIR and seizure list. In the FIR the informant did not disclose the name of the petitioner as seller of the recovered duplicate article i.e.

Binay ji ki nimki and in the seizure list any details of the petitioner's shop has also not been mentioned as the production place of the alleged duplicate articles, in the light of these facts, let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Court concerned in connection with Nokha P.S. Case No. 40 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
