JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364A and 120B of the Indian Penal Code.

The F.I.R. named accused and some unknown came to the clinic of the informant and attempted to abduct him. On alarm the police came and the informant was rescued. Submission of the petitioner is that during investigation the police got secret information that one Randhir Rai, son of Rama Nand Rai was involved in the occurrence. Later on, the same Randhir Rai became the petitioner Ranveer Singh having different parentage.

Learned Additional Public Prosecutor opposed the

Patna High Court Cr.Misc. No.51817 of 2016 (2) dt.20-12-2016 2/2 prayer for anticipatory bail on the ground that cognizance has already been taken against the petitioner.

Considering the facts that there is no substantial material against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur/Successor Court in connection with Samastipur (Town) Police Station Case No. 567 of 1999, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
