The petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 31.03.2022 and has antecedent of one case and the informant alleges that petitioner was apprehended with a stolen motorcycle and disclosed that the motorcycle was stolen from Patna along with Ankit. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that nothing was recovered from his conscious possession and he came to be implicated on account of high

Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that from perusal of the allegations as alleged in the FIR, it would manifest that petitioner was apprehended along with the stolen motorcycle. Considering the submission made by the learned APP, the Court is not inclined to release the petitioner on bail. However, the petitioner would be at liberty to renew his prayer for bail after framing of charge.
