2. The petitioner is seeking regular bail in connection with Malsalami P.S. Case No. 193 of 2024, for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act 2022.

3. As per allegation, while the informant along with police personnel reached the place of occurrence, the accused persons including the petitioner tried to flee away, but was apprehended. On search, 350 liters illegal liquor was recovered from the a tempo.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered

Patna High Court CR. MISC. No.56249 of 2024(2) dt.02-08-2024 2/2 from possession of the petitioner. He has also submitted that the petitioner is neither the owner nor the driver of the pick-up van. The petitioner is under custody since 14.05.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named, is directed to furnish bail bond after two months from today and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna City in connection with Malsalami P.S. Case No. 193 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
