JUSTICE SUDHIR SINGH ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Fatehpur P.S. Case No. 249 of 2015 pending in the Court of Judicial Magistrate, Ist Class, Gaya for the offences instituted under Sections 302 and 3(2) (v) SC/ST Act.
As per prosecution case that the petitioner after taking meal in the house of the informant compelled her husband to go with him and thereafter he threw nearby pond because her husband was not ready to accompany him and thereafter her husband died due to drowning.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner has falsely
Patna High Court Cr.Misc. No.46302 of 2015 (4) dt.03-02-2016 been implicated in the present case. No motive has been alleged against the petitioner for committing the alleged crime. There is no eye witness to the alleged occurrence.
On behalf of the State, it has been submitted that there is specific allegation against the petitioner for committing the murder of the deceased.
Considering the aforesaid facts and circumstances of the case, I am not inclined to release the above named petitioner on anticipatory bail, the same is rejected.
Anyhow, if the petitioner surrenders in the court below within a period of four weeks, the same shall be considered on its own merit without being prejudiced by this order. (Sudhir Singh, J) B.Kr./- U T
