JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-11-2016 The present application has been filed for modification of the order dated 22.07.2015 passed in Cr. Misc. No. 27267 of 2015 to the extent of extending the period of surrender.

The petitioner being Panchayat Mukhiya was granted anticipatory bail in a case registered under Sections 409/34 of the Indian Penal Code.

The accusation is of misappropriating the money under MANREGA scheme to the tune of Rs. 4,94,252/- by the petitioner being Panchayat Mukhiya and Panchayat Rojgar Sewak.

It was submitted by learned counsel for the petitioner that petitioner has maliciously been roped in the present case and further undertook that petitioner would deposit 60% of the misappropriated amount within a period of three weeks. Hence, on deposit of 60% of the misappropriated

Patna High Court Cr.Misc. No.47103 of 2016 (2) dt.16-11-2016 2/2 amount and the fact that petitioner being lady having no criminal antecedent, this Court granted anticipatory bail to the petitioner vide order dated 22.07.2015.

It is submitted by learned counsel for the petitioner that the amount could not be deposited within three weeks but now it has been deposited. Hence, period of surrender may be extended.

Since the petitioner is lady and a statement has been made in para 3 of the petition that petitioner has no criminal antecedent, the order dated 22.07.2015 passed in Cr. Misc. No. 27267 of 2015 is modified to the extent that the period of surrender is extended by three weeks from the date of receipt/production of the copy of this order. The bail bonds of the petitioner shall be accepted by learned Court below on filing proof with regard to the deposit of 60% of the alleged misappropriated amount. Accordingly the modification application is disposed of in connection with Paroo P.S. Case No. 168 of 2014, pending in the Court of learned Chief Judicial Magistrate, Muzaffarpur.
