The petitioner is apprehending his arrest in a case registered under Sections 379/411 of the Indian Penal Code. The prosecution case, in brief, is that in the night of 29.8.2015 at about 24:00 hours the Apache motorcycle bearing registration No. BR-33N/3404 has been removed by unknown persons from Ram Janki Mandir, Mathurapur.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. There is no recovery from his possession. He has not been put on Test Identification Parade. His

Patna High Court Cr.Misc. No.50366 of 2016 (2) dt.24-11-2016 2/2 name has come on the confessional statement of co-accused. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Dalsinghsarai, Samastipur in connection with Dalsinghsarai P.S. case No.347 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
